The Demise of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Falter

Europe felt a moment of respite on Monday, as the crisis sparked by the announcement of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been defused. A Washington representative spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Moscow made its response: an extensive attack of rocket attacks on Kyiv.

The Cycle of Negotiation and Warfare

The succession of opposing developments captured the grim essence of the recent timeframe. By day, negotiation efforts are waged: hopeful statements are issued from various governments. Considerable effort is expended on restraining particular approaches. By night, the Kremlin brutally reminds the world that, for them, conflict continues to be the main instrument for achieving "peace".

Nighttime Reality

As military strikes progressed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was revealed. Ukraine is capable of detecting rocket firings from across the border, a capacity provided through timely intelligence. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to intercept incoming aerial threats flew past – modern combat jets supplied to Ukraine by European allies.

Moments later, Kyiv's anti-aircraft weapons engaged: multiple launches fired to intercept a Russian ballistic missile. This was a modern interception technology at work, most likely delivered by Western nations. Every firing jolts you unexpectedly, rattling buildings. The instant of fear quickly transforms into resigned acknowledgment: perhaps the incoming missile won't hit its mark this time, sparing the city from ruin and additional electricity failures.

Continuous Dangers

Following this, a large-caliber weapon fired at a drone in the vicinity, part of a mobile-fire group – probably allied-provided weaponry. Sadly, the bullets missed the hostile drone – it maintained course toward its objective.

With pauses, this carried on until dawn. Kyiv awoke to the daybreak reports: seven people killed, damage and infrastructure problems in multiple buildings as a result of the nocturnal offensive. As always, everyone still maintained normal activities – experiencing conflict. But those full day demonstrated Ukraine's vital need on external assistance – a dependence that neighboring countries are evidently unprepared to fill in the short term.

Ineffective Peace Efforts

The comprehensive proposal from American leadership generated strong feelings, controversy and serious worry – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new proposal from American administration follows the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They manage the tension but never actually win the battle. This trend will, undoubtedly, continue.

Strategic Calculations

It is easy to blame certain parties of repeatedly advocating Moscow's conditions. But that does not seem to be the complete picture. Washington functions according to a premise well known to experienced diplomats: you cannot achieve through diplomacy what you have been unable to protect through force. The White House presumes that it is unfeasible to force Russia to abandon the land that it already controls in Ukraine's occupied territories.

The challenge is that while recognising this factual reality, Washington does little to prevent Kremlin actions, through words or deeds, from assuming that the situation will not shift further in its benefit in the months ahead.

Conflicting Perspectives

Therefore, Moscow is convinced that the clock favors them – that Ukraine and its allies are nearing depletion. Their motivation to agree to terms that does not give them the maximum possible gain is close to zero. There may be many attempts to achieve ceasefire, but they will persist as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, gradually sacrificing civilians and areas but preventing a complete military breakdown until conditions improve in its favour.

Existing Situation

Realistically, there are no actual prerequisites for a armistice. Now, individual motivations are becoming relevant: personal goals to broker a ceasefire and secure international recognition, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the country's interests against any initiative Kyiv finds unworkable, so that their priority does not move to homefront challenges. And although their task will now be considerably more difficult after recent developments, it remains highly unlikely that this will modify their basic position.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a just a single week to eliminate the 28 points of the current initiative. Aggressive and erratic handling of the matter by Washington, opposition by Ukraine and the remaining European nations, along with soothing efforts of diplomats, and finally, latest revelations, all did their job.

While new plans based on established approaches are imminent, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to counter political attacks from Washington that are based on Russian demands and show particular unwillingness to modify developments, if they maintain solidarity and enhance their military capacity at a much faster pace. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the foreseeable future, primarily depend on sustained allied backing.
